Resumen:

Este artículo reconstruye la genealogía de la ley moral de la filosofía práctica kantiana remitiéndola a la anomalía del derecho de equidad, el cual, por carecer de mecanismo de coerción, es segregado del ámbito del ius, con lo que la exterioridad del deber resulta transferida al pabellón de la conciencia moral, donde resonará como culpa que instituye la subjetividad en la diferencia (homo noumenon/homo phaenomenon) de la sujeción.

Abstract:

This article reconstructs the genealogy of the moral law of Kant's practical philosophy relating it to the anomaly of the right to equality. Due to a lack of enforcement mechanisms, the right to equality is segregated from the scope of ius, which is the externality of duty transferred to the moral conscience, where it resonates as guilt that establishes subjectivity in the difference (homo noumenon / homo phaenomenon) of the subject.
