Resumen:

Este artículo se propone mostrar los importantes vínculos existentes entre democracia, derechos humanos y filosofía. Presenta el sistema político de Suiza, sometido constantemente a una tensión entre el respeto a los derechos humanos y el respeto a la democracia, debido a su sistema de democracia semi-directa. Este artículo asimismo subraya claramente la relevancia internacional del problema de Suiza. Más aún, este trabajo demuestra hasta qué punto la cuestión aquí analizada tiene sus raíces en la filosofía política occidental y no es, por tanto, 'puramente' legal.

Abstract:

This article aims to demonstrate the important links that exist between democracy, human rights and philosophy. It presents the Swiss political system, which is constantly subjected to a tension between the respect of human rights and the respect of democracy, due to its semi-direct system of democracy. This article also highlights clearly the international relevance of the Swiss problem. Moreover, this contribution shows how much the question analysed is rooted in Western political philosophy and is, therefore, not ‘purely’ legal.
