Resumen:

El trabajo trata dos cuestiones convergentes. La primera aborda la búsqueda de una fundamentación teórica transversal e incontrovertible en la que apoyar los Derechos Humanos. La segunda parte se ocupa de la relación entre derechos e igualdad de
oportunidades. El tratamiento de ambas cuestiones muestra el primado normativo de la razón práctica frente a lo teórico y propone la necesidad de reformular la jerarquización de derechos de cuño rawlsiano.

Abstract:

This work addresses two converging issues. The first deals with the search for a theoretical and incontrovertible foundation supporting Human Rights. The second part deals with the relationship between rights and equal opportunities. The treatment of both questions shows the normative primacy of practical reason over theory and suggests the need to rethink the Rawlsian hierarchy of rights.
