Resumen:

El presente artículo pretende establecer las relaciones entre la Ética, la Moral y el Derecho desde las vertientes iusnaturalista y positivista. Y la conexión de estos niveles, el ético y el jurídico especialmente, se nos propone claramente en relación con los derechos humanos. En este sentido cabe citar además, por su actualidad, el iusalternativismo. En este contexto se hace imprescindible examinar el fundamento o fundamentos de los derechos humanos que permitan su protección en el futuro, sobre todo desde el punto de vista del consensualismo. Por último, nos centramos en la estructura de los derechos humanos y la necesidad de su persistencia para evitar tragedias humanas como fueron las experiencias deshumanizadoras del Holocausto, del genocidio y de los campos de exterminio.

Abstract:

The present article tries to establish the relationship between Ethics, Morality and Law from the iusnaturalistic and positivist point of view. We clearly show the link between these levels, especially the ethical and legal, and human rights. In this respect the paper also cites, because of its present importance, an ius-alternativism. It is essential in this context to examine the foundation or foundations of human rights that allow for its future protection, above all from a consensualist point of view. Finally, we focus on the structure of human rights and the necessity for their persistence in order to avoid tragedies such as the dehumanizing experiences of the Holocaust, genocide, and extermination camps.
