Resumen:

La situación jurídica de los migrantes irregulares los sitúa en una condición de vulnerabilidad en distintos ordenamientos y leyes, dado que un gran número de Estados y la misma Unión Europea asocian su presencia a inseguridad y amenaza. En este contexto, surge la pregunta sobre la garantía de los derechos humanos por parte de los Estados en los migrantes que están en situación de permanencia irregular, y la necesidad de establecer una constitucionalidad de derechos humanos.

Abstract:

The legal status of irregular migrants makes them vulnerable to different legal systems and laws, especially given that the European Union and many of its Member States associate their presence with insecurity and threat. In this context, the question of the guarantee by States of human rights for migrants in irregular residence situations arises, as well as the need to establish a constitutionality of human rights.
